MEETING

WEDNESDAY, 7:00 PM AUGUST 04, 2004

 

Chairman Nettleton called the meeting to order, and established a quorum. Members of the Elmore County Planning and Zoning Commission present were Chairman Nick Nettleton, Vice-Chairman Al Sobtzak, , Doug King, Courtney Hiler, Todd Waite and K.C. Duerig. Also present were Attorney of Record Phil Miller, Senior Planner Bonnie Sharp, and Hermila Kuannark, Administrative Assistant.

 

PUBLIC HEARINGS

1. BERNIE BROWN – CAFO Application for a Dairy

Chairman Nettleton read a letter from Danette E. O'Donnell, stating the neighboring property owners were notified properly, and how the record was left open to gather testimony on select items.

 

Bernie Brown stated the information the Commission requested was submitted. He deferred his testimony to his attorney Clifford Brown.

 

Clifford Brown, attorney, stated all information requested has been submitted. He stated they would be flexible and work to meet any requests from the Highway district. Chairman Nettleton clarified if that included the Idaho Department of Transportation. C. Brown stated yes.

 

Chairman Nettleton asked for any testimony regarding the information submitted.

P. Miller gave explanation how proceedings are heard, he also stated reasons commission did not want to accept testimony that was duplicate of what was gathered from last hearing.

P. Miller stated the public hearing must follow a procedure, people cannot just stand up and yell out what they want and make accusations. If the public has complaints about the ordinance, those complaints are not addressed with this body.

 

Debra Bessey, speaking from audience, requested the test results be read into the record.

Chairman Nettleton read the results, stated he did not have the expertise to interpret the lab information.

P. Miller stated the Commission may ask those disrupting to be removed from the meeting. All information will be accepted in the record and will be discussed when they make a decision.
